Terms of Service
Effective date: July 18, 2026 · Last updated: November 7, 2026
These Terms of Service ("Terms") govern your access to and use of Kunbaa, operated by Vritul Pty Ltd, a company registered in Australia ("Kunbaa", "we", "us", or "our"), including the website, mobile apps, family tree tools, memories, posts, announcements, chat, calls, invites, events, tasks, AI-written family digests and event task suggestions, billing, and optional paid features (together, the "Service"). By creating an account or using the Service, you agree to these Terms, to our Acceptable Use Policy, and to our Privacy Policy. If you do not agree, do not use the Service.
By signing in to Kunbaa you agree to these Terms and the Acceptable Use Policy, confirm you have read the Privacy Policy and that you are 18 or over, and take responsibility for what you do and publish with it. When a new version changes what you agree to, we ask you to confirm it once, the next time you use Kunbaa. Until you agree, you cannot use Kunbaa, apart from signing out, reading these documents, and using your rights over your own data, such as asking for a copy or deleting your account.
1. Eligibility and age
- You must be at least 18 years old to create an account or use the Service. Kunbaa is an adults-only service and is not directed to children. We do not offer child or teen accounts, and you may not create an account for, or let your account be used by, anyone under 18.
- Children and other minors take part in Kunbaa only as information an adult family member chooses to record — for example a person in a family tree, or a photo or memory an adult uploads. An adult who adds information about a child is responsible for having the authority to share it and for how it is used in their family space.
- In these Terms a parent or guardian means an adult with legal responsibility for the child where the child lives. Follow any court order about a child. Do not start or use a care page about a child if a court order or the law says you may not.
- You may not use the Service if you are barred from doing so under the laws that apply to you.
2. Your account
- You must provide accurate account information, keep your sign-in methods secure, and tell us promptly if you believe your account has been compromised.
- Kunbaa may link approved sign-in methods, such as email, mobile, Google, or Facebook verification, to the same account when the information matches.
- You are responsible for activity on your account and for choosing relatives carefully when you invite them into a family space.
- You may not share, sell, or transfer your account, and you may not impersonate another person or misrepresent your relationship to a family.
3. Family spaces, roles, and permissions
Kunbaa is built for private family collaboration. A family space may include family trees, member profiles, posts, memories, chat, calls, events, tasks, billing context, and other shared information.
- Only share information you have the right to share.
- Family admins and invited members may have different controls depending on the product surface and settings available at the time. Where available, a family admin can set each member's access level (admin, editor, or viewer) and switch individual permissions — posting on the family wall, adding people to the tree, and messaging family members — on or off per member, and a member can ask an admin for a permission they do not hold. An author may also narrow a post to their extended family or their household, as recorded on the family tree; Kunbaa applies that choice on its servers wherever the post can appear.
- You must respect the access settings, privacy expectations, and boundaries of other family members.
- Do not add, share, or expose information about another person unless you have the right or appropriate permission to do so.
- Where we make it available, you may bring people onto your family tree from a file you already hold — a family-tree file in GEDCOM format exported from another genealogy product, or a chat export made by WhatsApp. The file is one you choose; it is read in your browser or on your device and is not uploaded to Kunbaa; no message in a chat export is read, sent, or kept; and only the people, relationships, and dates you confirm are written to your family tree, through the same steps as adding a relative by hand. Adding people this way needs the same access as adding them by hand, and you are responsible for having the right to add the people it names, exactly as in the previous bullet.
- If location or Family Safety features are available to you, use them only with clear consent from the people involved. Location data is best-effort and cannot be guaranteed accurate, current, or available, so do not rely on it for safety-critical decisions. Kunbaa is not an emergency monitoring or dispatch service — in an emergency, call your local emergency number and rely on official emergency services.
- Use extra care with children's information, elder care notes, health details, identity documents, financial information, adoption context, family conflict, or other sensitive matters.
4. Your content and the license you grant
You keep ownership of the content you upload, post, send, or add to Kunbaa, including names, photos, videos, documents, recipes, voice notes, stories, messages, comments, events, tasks, family-tree details, and the people and details you confirm from a file you import ("Your Content").
You grant Kunbaa a limited, worldwide, non-exclusive, royalty-free license to host, store, process, display, transmit, back up, secure, and format Your Content as needed to operate, protect, improve, and support the Service. This includes actions such as generating thumbnails, syncing across devices, delivering notifications, rendering family trees, enabling search, and sharing Your Content with the relatives you choose. This license exists only to run the Service for you and your family, ends when Your Content is deleted from active systems (subject to backups and the retention periods in our Privacy Policy), and does not permit us to sell Your Content or use it to target advertising.
You are responsible for making sure Your Content is lawful, accurate enough for the use you make of it, and does not infringe another person's rights.
5. Private by default
Kunbaa is private by default. Your family space is shared with the relatives you invite and the members who already have access — not with the public. We do not sell your personal data, and we do not use private family content to target advertising. Kunbaa Plus and Kunbaa Ultra have no ads, in the app or when you are signed in on kunbaa.com. Any other advertising is limited to public marketing pages and is not personalised, as described in our Ads & Monetization Policy. We will update these Terms before any ad appears anywhere else.
6. Acceptable use
The full rules are in our Acceptable Use Policy, which forms part of these Terms. It covers sexual content involving minors, nudity and sexual content, violence, hate and harassment, self-harm, illegal activity and deception, and adds rules for families and children. In short, you agree not to misuse Kunbaa. For example, you must not:
- Break the law or violate another person's rights.
- Upload malware, spam, abusive content, deceptive content, or anything designed to disrupt the Service.
- Harass, threaten, impersonate, exploit, or deceive other people through Kunbaa.
- Scrape, copy in bulk, reverse engineer, overload, or try to access parts of Kunbaa you are not allowed to use, or attempt to circumvent security, rate limits, or usage limits.
- Use Kunbaa for emergency response, professional medical advice, legal advice, financial advice, or safety-critical decisions.
- Upload content that exploits or endangers children, violates privacy, promotes violence, or is otherwise unlawful or harmful.
Up for grabs
You can offer things you own to your family on Kunbaa. Kunbaa does not take part in what happens next: it does not sell, buy, check, deliver or insure anything, and it does not handle money between members. Anything you agree is between you and the relative you agree it with. You may only offer things you own and are allowed to give or sell. You must not offer:
- weapons, ammunition, or parts of them;
- alcohol, tobacco, vapes, or nicotine products;
- medicines, supplements sold as treatment, or drugs;
- animals;
- anything recalled, or baby and children's products that no longer meet the safety standards where you live (for example car seats, cots, and prams);
- stolen, counterfeit, or illegal items, or anything you are not allowed to give or sell.
Members under 18 cannot offer or ask for items. We may remove a listing or limit your use of Up for grabs if it breaks these rules, and repeated or serious breaches are handled under section 15 (Suspension, termination, and deletion).
7. Calls, messages, invites, and user content
Kunbaa may let you send invitations, messages, announcements, comments, reactions, call requests, push notifications, and related family communications. You are responsible for using these features respectfully and lawfully.
If you invite someone from your contacts, make sure you are comfortable sending that invitation and sharing the related family context with that person.
Where we make it available, Kunbaa may create and maintain family group chats from the relationships recorded on your family tree — for example a household, a set of siblings, or an extended family. Who belongs to such a group follows the tree and is kept in step with it by Kunbaa: it is not edited by hand, and the group cannot be renamed or left while it exists. If we switch the feature off, existing groups stay readable and nothing in them is deleted by that switch. Groups you create yourself are unaffected.
Calls depend on device permissions, network quality, and third-party infrastructure. Calls are voice and video calls in the mobile app — one-to-one on every plan, or a group of up to 6 people including the person who starts it, which a member on Kunbaa Plus or Kunbaa Ultra can start and anyone in the family space can join (we may change the size of a group) — between members of the same family space; they may be unavailable, delayed, or limited by release profile, plan, platform, or local connectivity, and must not be used for emergency communications. Kunbaa does not record or store calls. On Kunbaa Plus and Kunbaa Ultra, a call can be translated live: what each person who allows it says on that call is turned into text and translated by our AI provider while the call is live, as the Privacy Policy describes. Nobody's voice is sent without their own yes on that call, and nobody under 18 can give it.
We may, but are not obligated to, review, moderate, limit, or remove content that we reasonably believe violates these Terms or the law, or that is reported to us. You can report content or a member through the in-product tools where available, or by contacting us.
8. Kunbaa AI: family digests and event task suggestions
Kunbaa's own AI, Kunbaa AI, writes family digests — short, periodic recaps of the family updates you missed, drawn from your own family's tree, memories, posts, and events — which Kunbaa writes and sends to you. And, when you organise an event and ask on that event's page, it suggests a short list of preparation tasks for that event, which you may keep, edit, drop or report. Where it is switched on, you can also ask Kunbaa AI about your family, typed or spoken (section 8A). Digests and event task suggestions are included for every account at no cost. Both happen only with your permission, which you give once and can withdraw in Settings (our Privacy Policy, Section 10, says exactly what is sent).
- Read-only. A digest summarises and a suggestion proposes. Kunbaa's AI never posts, comments, messages anyone, creates an event or task, or changes your family tree; a suggested task is created only when you keep it. Every change inside your family space is made by a person.
- Permission-scoped. A digest is written only from what your own signed-in account is already permitted to see, through the same access rules that apply to you, and tasks are suggested only for an event you may organise, from that event's own details.
- We never use your content to train AI models, and our AI provider is not allowed to either.
- No reliance. AI output may be incomplete, inaccurate, or outdated. A digest is a convenience summary, not a record — the family updates behind it stay readable in the app — and a suggested task is a starting point, not advice; you remain responsible for checking them before you act on a summary or a suggestion, and you can report any suggestion from the event page.
- Do not rely on AI output alone for health, legal, financial, safety, emergency, or other high-stakes decisions.
- Delivery, metering, and availability. Digests reach you as notifications and in a weekly email, so declining the notification permission means no digest notifications will arrive. Digests and event task suggestions are metered: we apply technical guardrails such as usage budgets, rate limits, and abuse-prevention checks, and if a budget is exhausted a digest may be shortened, delayed, or skipped, and a suggestion replaced by the standard starter tasks, until the allowance resets. These are operational limits, not a plan entitlement — both are included for every account, free and paid alike. The frequency, coverage, and availability of digests and suggestions may also change or be limited by platform, territory, or feature status.
- Live translations in calls are made by a machine and can be wrong or incomplete. Don't rely on them for medical, legal, financial or emergency decisions.
8A. Kunbaa AI
Kunbaa AI is Kunbaa's own assistant. It answers your questions about your family, helps you make plans and goal plans, and writes the short family summaries and event task suggestions described in Section 8. Where it is switched on for you, you use it with your permission.
- Only what you can already see. Kunbaa AI uses only what your own account is already allowed to see.
- Your family's words never train AI models, ours or anyone else's.
- Private to you. Your conversations with Kunbaa AI are visible only to you. Each message is kept for 30 days unless you keep the conversation.
- Family stories (Beta). On Kunbaa Plus and Ultra, Kunbaa AI can write a short story about a relative when you ask on their page, only from what the family has shared and only from relatives who have allowed stories. It is in Beta: read it as a starting point, not a record.
- Your switch. You can switch Kunbaa AI off at any time in Profile.
- It can be wrong. Kunbaa AI can make mistakes or miss things. Check what it tells you before you rely on it, and do not use it alone for health, legal, financial, safety or emergency decisions.
- Using it well. The rules in Section 6 apply to Kunbaa AI. Do not use it to harass or harm anyone, to make content that is unlawful or sexual, or to deceive people, and do not try to get around its safety checks.
What is sent, to whom, and how long it is kept is set out in our Privacy Policy, Section 10.
8B. Kunbaa Care (beta)
Kunbaa Care lets a family keep care details and tasks in one private place, on a care page about one person, or a property. Depending on what is open for your family, a page can hold contacts, medicines, appointments, an emergency card, readings your family types in, a weekly timetable, school details, notes of where papers are kept, and for a property its jobs, bills and value notes, and who does what and when. It is a beta feature that opens in parts. It may change, a part may not be available to every family, and we may pause or end it. It is not open in the United Kingdom or the European Economic Area.
Kunbaa Care is a record-keeping and coordination tool. It is not an emergency service and not medical advice. It is not a medical record kept by a doctor or hospital, and it does not replace one. Nothing in it diagnoses, treats, or recommends a treatment, a medicine, or a dose. Readings are only numbers your family typed: it does not check them or judge them, and it shows no ranges, targets or alerts. In an emergency, contact your local emergency number. For medical questions, ask a qualified health professional. A reminder can fail. Keep your own record of dates that matter.
Kunbaa Care is a place to keep records. It is not legal, tax, valuation, financial, insurance or property advice. What it shows comes from your family, and Kunbaa does not check it. It does not prove who owns anything. Keep your original documents. A label such as owner or co-owner is your family's own, and a figure on a value note is your family's own note.
You can list the carers, nurses, and helpers your family has hired yourselves, and the tutors, teachers, coaches and trades your family works with. Where your family hires them, you choose, hire, pay, and manage them directly. Kunbaa does not employ, supply, vet, check, recommend, rate, insure, or pay any of them, runs no police checks on them, is not a party to any arrangement between you and them, and does not book or take payment for their services. You are responsible for that arrangement, including any law that applies to employing or engaging someone where they work. Any dispute about their work is between you and them.
Only add a person's details if you are allowed to, and only what the family needs to work with them, such as a name, a role, and a phone number. Kunbaa Care does not ask for identity numbers, bank details or tax numbers, and it has no field for them, so do not type them into a note. A care page can note where a paper is kept and when it ends. It does not hold the paper.
Care details are shared only with the people the care page's main carers choose, as shown on each part of the page. Before you add someone's health details, make sure they agree, or that you are allowed to act for them. Kunbaa never uses Care details for advertising and never uses them to train any AI.
Where care pages about a child are open for your family, only the child's parent or guardian (Section 1) may start one, and they give their own agreement in the app before any detail about the child is kept. You are responsible for what you say there being true. Where property pages are open for your family, whoever starts one says that they help look after the property for the family.
Families decide who is on a care page. We act on the law, court orders, regulators and broken rules. Coming off a page ends access, not rights. If you are listed and have no account, write to us at privacy@kunbaa.com. Send a court order about a care page to the same address, in writing.
To withdraw an agreement given for a care page, follow How to withdraw in our Privacy Policy, Section 9a.
8C. The help assistant on kunbaa.com
- The assistant is automated and answers from Kunbaa's published pages.
- It can make mistakes or be out of date, and Kunbaa's published pages, these Terms and the Privacy Policy prevail over anything it says.
- It cannot change an account, give a refund or credit, or make any promise or offer on Kunbaa's behalf.
- It does not give medical, legal, tax or financial advice and is not for emergencies.
- Fair-use limits apply and Kunbaa may pause it at any time.
- The acceptable use rules in Section 6 apply, including attempts to make it break its rules, to automate it or to scrape it.
- You can ask for a person, and a person replies by email.
9. Third-party AI apps
Kunbaa does not offer a way to connect a third-party AI app or assistant to your account.
10. Subscriptions, billing, and refunds
- Kunbaa is free to join and use. The family tree, the family wall, chat, voice and video calls, events and Family Safety are available to every member of a family on the free plan. What a paid plan changes is how much a family can keep, and for how long — the limits set out in the four bullets below.
- Group calls. Starting a group call is part of Kunbaa Plus and Kunbaa Ultra, and anyone in the family can join one. A group call holds up to 6 people, including you. We may change these limits. If we do, we will say so on this page.
- Photos and videos sent in chat, on the free plan. A photo or video sent in a Kunbaa chat on or after December 5, 2026 is stored on our servers for 90 days from the time it was sent, and may then be removed; one sent before December 5, 2026 keeps the 12 months that applied when it was sent. Copies already saved on a member's phone are not removed. This applies only to media sent in chat: nothing posted to the family wall, an event or a person's profile is affected. Before that window ends, a member who administers or edits the family can save a copy of the file to the family archive, where that copy is kept under the same terms as the rest of the archive. When a file does expire, the message itself remains and a placeholder tells you the file is no longer kept; we mark it expired and then allow at least 14 days before the file is actually removed from storage, so a family that notices in time can still ask us to keep it. The copy your own phone keeps stays on that phone (depending on the app version, in its cache, which your phone may clear at any time, or in an encrypted store the app keeps); it is not a backup, and we cannot restore it.
- Photos and videos sent in chat, on Kunbaa Plus. While a family is on Kunbaa Plus, photos and videos sent in its chats stay in those chats rather than expiring. A file kept while the family was on a paid, settled subscription stays kept permanently: if the subscription later lapses, that file is never put back on an expiry clock. Files sent after a subscription ends follow the free plan's window above.
- Forward-only. This retention rule applies only to media sent in chat after we switched it on. Media already stored before that date, and media that carries no chat marking, is treated as archive content and can never expire under this clause.
- Video length in the family archive. On the free plan, videos added to the family archive must be short clips, and a longer video is refused at upload with a message that says so — nothing is silently truncated or re-encoded to fit. On Kunbaa Plus, longer videos are accepted, up to the maximum file size the platform supports. Refusing an upload never affects anything already in your family's archive.
- At least 30 days' notice before we shorten anything. If we change these Terms or our practice in a way that shortens how long your family's content is kept, we will tell you at least 30 days before it takes effect — by email to the address on your account, and on kunbaa.com — so that you can save what matters, export your archive, or cancel first. This is in addition to the price-change notice below.
- Two plans, two billing intervals. Kunbaa Plus and Kunbaa Ultra are each sold monthly or yearly, and you choose the plan and the interval at checkout. One person pays for the plan. A plan covers the payer's household: their partner, their children and their partner's children, adopted children included, and both sets of parents, up to 20 accounts. Other relatives use Kunbaa free, or take their own plan. Nobody the plan covers needs a payment method.
- Where you can buy it. A paid plan may be bought on the Kunbaa website at kunbaa.com, and through any app store where we make it available. The price, currency, taxes and renewal terms that apply to you are the ones shown to you at checkout, on the rail you bought through. Store prices are set in your local currency and may include tax, so they will not always match the figure shown on kunbaa.com.
- Who charges you, and who you cancel with. If you subscribe on kunbaa.com, Stripe processes the payment and you manage or cancel the subscription from your account under Settings → Plans → Manage billing, which opens the secure Stripe billing portal. If you subscribe through an app store, that store charges you under its own terms, and you manage, change and cancel that subscription in that store's account settings — Kunbaa cannot cancel it or refund it for you. Kunbaa does not store your card details in either case.
- Apple Family Sharing. Apple Family Sharing is enabled for Kunbaa Plus on the App Store. If a member of your Apple family group shares their App Store subscription with you under Apple's Family Sharing, it unlocks Kunbaa Plus on your Kunbaa account the same way as your own purchase would, for as long as Apple reports that share as active. That is Apple's mechanism, run under Apple's terms, and it is separate from Kunbaa's own family plan: one person pays for Kunbaa Plus and the people it covers under “One plan, two billing intervals” above use it, whether or not they belong to the buyer's Apple family group.
- Free trial, where offered. A first paid subscription includes a free trial period — currently 14 days, and always shown at checkout before you confirm. A payment method is required to start a trial, and unless you cancel before the trial ends, the subscription begins and the first charge for your chosen interval is made automatically. Trials are not offered to accounts that have subscribed before. Trial length and availability may differ on an app store, and what that store shows you at checkout governs.
- Auto-renewal. Subscriptions renew automatically for a further month or year, matching the interval you chose, until you cancel. Cancel before the next renewal, with whoever bills you.
- Price changes. You keep the price you subscribed on. If we change what a plan costs, we will give you at least 30 days' notice before it affects you — by email to the address on your account, and on kunbaa.com/pricing — so that you can cancel before the new price applies. We will not change the price of a billing period you have already paid for. Where an app store requires its own consent step for a price rise, that step applies in addition to this notice. If we lower a plan's price, a subscription bought on kunbaa.com moves to the lower price from its next renewal, and an app store applies a lower price under its own rules.
- You can cancel at any time. Cancelling stops future renewals and takes effect at the end of the period you have paid for; there is no cancellation fee and no minimum term. It does not by itself refund a billing period that has already started, unless a refund is required by law. For a plan bought on kunbaa.com, we refund a charge made by mistake, a duplicate charge, and a charge made after you cancelled; ask at support@kunbaa.com. Refunds for a purchase made through an app store are handled by that store under its own policy. Your family's archive is not deleted when a paid plan ends: content your family has already added stays readable to your family, files kept while you were on Kunbaa Plus stay kept, and what changes is what happens next: adding is limited to the free storage allowance, archive videos return to short clips, and photos and videos sent in chat from then on follow the free plan's chat window.
- A founding-family year. Where we invite a family to be one of Kunbaa's founding families, redeeming the invitation on kunbaa.com gives Kunbaa Plus to that account's household for one year. It costs nothing, needs no payment method, does not renew and is never charged. An invitation is single-use and personal to the address it was sent to. If a paid subscription runs during the year, the subscription is what covers you and the year keeps counting down. When the year ends the account goes back to the free plan, and the archive is kept as described below.
- You can take your archive with you. You can ask us for a complete copy of your family's content at any time, on any plan including free, and we will prepare it for you. A self-serve export is being built; until it ships, the request goes through our support address. We do not charge for this and we do not require you to keep paying to get your own content out.
- Deleting your account does not cancel a store subscription. If you subscribed through an app store, you must cancel it in that store, otherwise it keeps renewing and you keep being charged even after your Kunbaa account is gone. A subscription bought on kunbaa.com is cancelled as part of deleting your account.
- Fair use of the shared archive. A paid plan provides shared storage sized for an ordinary family's archive, not unlimited storage. We may apply a fair-use ceiling to a family's shared space and adjust it over time as storage costs change; your usage page always shows where your family stands against the current one, and warns you before it is reached. Reaching it pauses new uploads — it never deletes anything already in your family's space, and it never blocks a chat message from going through.
- Storage allowances and included features may change over time. We will give notice of material changes as required by law, and where a change would shorten how long your family's content is kept, the 30-day notice above applies.
- Billing on kunbaa.com is offered only in supported territories. If we cannot lawfully sell to the country you are in, checkout will tell you so rather than complete.
- Nothing in these Terms limits non-excludable rights you may have under consumer protection laws, including the Australian Consumer Law where it applies.
11. Public website monetization
Kunbaa may monetize public website pages with advertising, sponsorships, affiliate links, analytics, or campaign measurement where permitted by law and consent choices. Any advertising there is not personalised, and none is shown to someone signed in on Kunbaa Plus or Kunbaa Ultra. Sponsored or affiliate placements are clearly labeled when used, and never appear in Kunbaa Plus or Kunbaa Ultra.
Signed-in family trees, private chats, private posts, private media, private events, private tasks, billing screens, and family admin areas are not third-party ad inventory. Read more in our Ads & Monetization Policy.
12. Third-party services
Kunbaa relies on third-party providers for hosting, storage, payments, app distribution, analytics, advertising, sign-in, email, notifications, AI infrastructure, and support. Your use of those providers may also be subject to their terms or policies.
Payments are processed by Stripe on kunbaa.com, and by Apple or Google for a subscription bought in their app stores. Where a plan is sold in an app store, we use RevenueCat to record the purchase and keep your entitlement in step with that store; RevenueCat receives the purchase and subscription records that come from the store, not your payment details.
We are not responsible for third-party services that we do not control, including external links shared by users.
13. Kunbaa intellectual property and feedback
Kunbaa and its software, design, branding, documentation, and content are owned by Vritul Pty Ltd or our licensors. These Terms do not give you ownership of our intellectual property.
You may not copy, modify, distribute, sell, or lease any part of Kunbaa unless we allow it in writing or the law allows it.
If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them to improve the Service, without obligation to you.
14. Availability and changes
We work to keep Kunbaa available and reliable, but we do not promise uninterrupted service. Features may change, improve, be limited, move behind a plan, or be removed over time.
Some features may be beta, preview, region-limited, platform-limited, or subject to store approval and operational requirements.
15. Suspension, termination, and deletion
We may suspend or terminate access, remove content, or limit features if you break these Terms, create risk for other users, create legal or security risk, fail to pay amounts due, or misuse the Service.
How we act. We act in proportion to what happened and what could happen next. In order, we may send a notice, remove content, restrict features, suspend the account, or close it. We may close an account for a serious breach, for repeated breaches after notice, or when the law requires it.
Immediate action. We act straight away, with no earlier notice, when content involves the sexual abuse or exploitation of a child, when there is a credible threat to someone's life or safety, when Kunbaa is being used for fraud or a scam, when an account has been taken over, or when a court, regulator or law tells us to.
We tell you why. When we act on your account, we tell you what we did and why, unless the law forbids it or telling you would put someone at risk or harm an investigation.
Appeal. You can ask us to look again. Reply to our message, or write to privacy@kunbaa.com, within 30 days. A person who was not part of the first decision reviews it and answers. See also the Acceptable Use Policy.
Your data when we close an account. We keep what the law requires and what we need to deal with the breach, for example a report to the authorities, and delete the rest as described on the account deletion page and in our Privacy Policy. Content your family already shares in a family space may stay available to the family members who have lawful access to it. Where the content was lawful, you can ask for a copy within 30 days of the closing. We never return content that is illegal, such as child sexual abuse material.
Your money when we close an account. We stop any subscription you bought on kunbaa.com so that it does not renew. A subscription bought through an app store must be cancelled in that store (Section 10). As Section 10 says for cancelling, closing an account for breaking these rules does not by itself refund a billing period that has already started, unless a refund is required by law. Nothing here limits rights you have under consumer protection laws that cannot be excluded, including the Australian Consumer Law where it applies.
You may stop using Kunbaa at any time and may delete your account as described on the account deletion page. Deleting your account or content may not immediately remove every copy from backups, logs, legal records, billing records, or family spaces where another admin or member still has lawful access, as described in our Privacy Policy.
16. Disclaimers
To the extent permitted by law, Kunbaa is provided on an "as is" and "as available" basis. We do not guarantee that every feature will always be error-free, uninterrupted, secure, or suitable for every purpose.
Location and Family Safety information is provided for convenience only and cannot be guaranteed to be accurate, complete, current, or continuously available. GPS, device settings, connectivity, and other factors can delay, omit, or misplace a location. Kunbaa is not an emergency, security, or safety-monitoring service and must not be relied on in an emergency; always contact your local emergency number and official emergency services.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
17. Limitation of liability
To the extent permitted by law, Kunbaa and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, use, or family records.
To the extent permitted by law, our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred Australian dollars (AUD 100).
Some laws do not allow certain exclusions or limitations. In those cases, the exclusions and limits apply only to the maximum extent permitted by law, and where a consumer guarantee applies, our liability may be limited to re-supplying the Service or paying the cost of re-supply.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Vritul Pty Ltd and its affiliates, officers, and staff from claims, damages, losses, and reasonable expenses (including legal fees) arising out of content you upload, your use of the Service, your breach of these Terms, or your violation of the law or another person's rights. This does not apply to the extent a loss is caused by us or cannot lawfully be shifted to you.
19. Governing law
These Terms are governed by the laws of Victoria, Australia, unless mandatory local consumer laws require otherwise. Courts located in Victoria, Australia will have non-exclusive jurisdiction, subject to any rights you have under applicable local law.
20. Dispute resolution
If you have a concern, please contact us first at privacy@kunbaa.com so we can try to resolve it informally. Most concerns can be settled quickly this way.
If we cannot resolve a dispute informally, the parties will work in good faith to resolve it, and either party may pursue available remedies in the courts identified in Section 19. Nothing in this section prevents you from raising a complaint with a consumer protection or data-protection regulator, or from exercising any non-excludable right you have under local law.
